CONDICIONES Y BASES LEGALES SORTEO “PARTICIPA y GANA SUDADERA SOSTENIBLE”

1.- EMPRESA ORGANIZADORA DE LA PROMOCIÓN

La Empresa Eja Design S.L.con domicilio en Sant Miquel 24, 17003, Girona, identificada con el número B55138796 y organiza el sorteo de ámbito nacional, a desarrollar a través de Instagram, exclusivo para usuarios residentes en territorio español de acuerdo con lo dispuesto en el apartado requisitos de participación.

La finalidad de este sorteo es la premiar la fidelización de los seguidores de las marcas.

Exoneramos a Instagram de toda responsabilidad por parte de los participantes. El sorteo no está patrocinado, avalado ni administrado por la red social.

2-FECHA DE INICIO Y FECHA DE FINALIZACIÓN

La Promoción  se iniciará el día 1 de febrero del 2024 a las 09:00 h y finalizará el 15 de febrero del 2024 a las 23:59h.

La Empresa se reserva la facultad de no proceder a llevar a cabo la acción promocional si para la fecha reflejada de comienzo de la misma no se ha registrado una participación superior a 1000. De igual manera, la Empresa podrá extender la terminación de la acción promocional por 2 semanas más, siendo la nueva fecha de finalización el 1 de marzo del 2024 a las 23:59h. en caso de que se registre un número mayor 1000 participación.

3.- REQUISITOS DE PARTICIPACIÓN Y MECÁNICA DE LA PROMOCIÓN

Los requisitos de participación serán los siguientes:

• Podrán participar aquellas personas que residan en Europa y sean mayores de 18 años.
• Sólo podrán participar aquellos Participantes que sean titulares de una cuenta en Instagram. No se permiten perfiles de grupos o empresas.
• Los Participantes deberán comentar la publicación de la marca en la red social Instagram etiquetando a 2 amig@s durante el periodo de participación.
• Los Participantes sólo podrán participar con un único perfil de Instagram. Si se detecta que un Participante participa con varios perfiles de Instagram serán descalificados.
• Aunque los Participantes escriban varios comentarios en una misma publicación, solamente participarán con un máximo de una participacion en el sorteo aleatorio.
• La aplicación acumulará menciones de un mismo Participante aunque estén en comentarios distintos.  

4.- CONDICIONES DE LA PROMOCIÓN Y PREMIOS

Se elegirá a un solo ganador de forma aleatoria. El ganador será comunicado el 17 de febrero del 2024 a través de los perfiles sociales de las marcas y la blog de la web https://owlstore.eu/es/blog/ .

El premio consistirá en una sudadera sostenible con bosillo de upcycling confeccionada con parapentes reutilizados de la marca de OWL, a elegir talla, color del modelo stroller que aparecen en la web owlstore.eu, incluye el envío sólo en territorio español peninsular, si el ganador reside fuera, deberà abonar el precio del transporte.

El premio no se podrá canjear por dinero en metálico o por cualquier otro premio, ni puede ser objeto de cambio o alteración. La Empresa se guarda el derecho de modificar el premio si al día de declarar al participante como ganador existiesen problemas de stock y colores del mismo y, por lo tanto, imposibilidad de poder dar el mismo.

El ganador podrá contactar con la Empresa durante el plazo de 15 días a contar desde la fecha en la que se anuncie en el perfil social de la marca. En caso de que en el plazo estipulado no se produjese tal contacto se procederá a declarar el sorteo desierto.

La celebración del sorteo, así como la concesión del premio quedan sujetos a la normativa fiscal vigente.

5.- DESCALIFICACIONES Y PENALIZACIONES

Si se evidenciase que cualquiera de los Participantes no cumple con los requisitos exigidos en las Bases, o los datos proporcionados para participar no fueran válidos, su participación se considerará nula y quedarán automáticamente excluidos de la Promoción perdiendo todo derecho sobre los premios otorgados en virtud de esta Promoción.

La Empresa se reserva el derecho de declarar el sorteo desierto.

6.- PUBLICACIÓN DE COMENTARIOS U OPINIONES

No se permitirán comentarios u opiniones cuyo contenido se considere inadecuado, que sean ofensivos, injuriosos o discriminatorios o que pudieran vulnerar derechos de terceros. Tampoco se permitirán comentarios contra un particular que vulneren los principios de derecho al honor, a la intimidad personal y familiar y a la propia imagen.  No nos responsabilizaremos de los daños ocasionados por los comentarios que hagan los Participantes en la Promoción, y que en cualquier momento pudieran herir la sensibilidad de otros Participantes.

La participación en la presente Promoción, así como la publicación de los comentarios que se realicen por parte de los Participantes en las publicaciones no podrán vulnerar bajo ningún concepto las Reglas comunitarias de Instagram ni las Condiciones de uso de Instagram.

Si se descubriese por parte de la Empresa el empleo de medios fraudulentos para la participación, tales como el empleo de bots en los comentarios, el premio no le será adjudicado y seguirá siendo propiedad de la Empresa.

7.-EXONERACIÓN DE RESPONSABILIDAD

A título enunciativo, pero no limitativo, no nos responsabilizamos de las posibles pérdidas, robos, retrasos o cualquiera otra circunstancia imputable a terceros que puedan afectar al desarrollo de la presente Promoción, así como tampoco nos responsabilizamos del uso que haga el Participante respecto del premio que obtenga de esta Promoción.

No asumimos la responsabilidad en casos de fuerza mayor o caso fortuito que pudieran impedir la realización de la Promoción o el disfrute total o parcial del premio.

En caso de que esta Promoción no pudiera realizarse, bien por fraudes detectados en la misma, errores técnicos, o cualquier otro motivo que no esté bajo el control de la Empresa y que afecte al normal desarrollo del Concurso, nos reservamos el derecho a cancelar, modificar, o suspender la misma, incluyendo la página web de participación.

8.- PROTECCIÓN DE DATOS PERSONALES

La Empresa responsable del tratamiento de sus datos es Eja Design S.L. con domicilio en Sant Miquel 24, 17003, Girona identificativo B55138796.

De conformidad con lo establecido en el Reglamento General de Protección de Datos, cada participante con la aceptación de estas Bases Legales consiente que sus datos personales sean incorporados a un fichero, titularidad de ésta, con la finalidad de gestionar el sorteo, así como difundir y dar publicidad a sus resultados, y tramitar la entrega del premio.

Le informamos que puede ejercer sus derechos de Acceso, Rectificación, Supresión, Oposición, Limitación del tratamiento, Portabilidad, olvido y a no ser objeto de decisiones individuales automatizadas mediante el envío de un e-mail a admin@owlstore.eu o bien mediante carta dirigida a la siguiente dirección: OWL – Ciudad de Granada 65, local. 08005, Barcelona, adjuntando en ambos casos copia de un documento identificativo.

Sin perjuicio de cualquier otro recurso administrativo o acción judicial, el Participante tendrá derecho a presentar una reclamación ante una Autoridad de Control, en particular en el Estado miembro en el que tenga su residencia habitual, lugar de trabajo o lugar de la supuesta infracción, en caso de que considere que el tratamiento de sus datos personales no es adecuado a la normativa, así como en el caso de no ver satisfecho el ejercicio de sus derechos.

Es por ello que el Participante declara haber sido informado de las condiciones sobre protección de datos personales aceptando y consintiendo el tratamiento.

9.- CAMBIOS Y ACEPTACIÓN

Nos reservamos el derecho de modificar o ampliar estas bases promocionales, en la medida que no perjudique o menoscabe los derechos de los Participantes en la Promoción.

El mero hecho de participar en el sorteo implica que el Participante acepta totalmente las condiciones de estas Bases Legales. Asimismo, la participación en un sorteo de esta naturaleza supone la aceptación de las normas de la red social Instagram a través del cual se desarrolla el mismo.

10.- LEGISLACIÓN APLICABLE Y JURISDICCIÓN

Estas bases legales se regirán de conformidad con la ley Española. Serán competentes para resolver cualquier reclamación o controversia que pudiera plantearse en relación con la validez, interpretación o cumplimiento de estas bases los Juzgados y Tribunales de la ciudad de residencia del Participante.

CONDITIONS AND LEGAL BASES OF THE GIVEAWAY “PARTICIPATE AND WIN A SUSTAINABLE SWEATSHIRT”

1.- PROMOTION ORGANIZING COMPANY

The Company Eja Design S.L. with address at Sant Miquel 24, 17003, Girona, identified with the number B55138796 and organizes the national raffle, to be carried out through Instagram, exclusively for users residing in Spanish territory in accordance with the provisions of the participation requirements section.

The purpose of this giveaway is to reward the loyalty of brand followers.

We exonerate Instagram from all liability on the part of the participants. The giveaway is not sponsored, endorsed or administered by the social network.

2-START DATE AND END DATE

The Promotion will start on February 1, 2024 at 9:00 a.m. and will end on February 15, 2024 at 11:59 p.m.

The Company reserves the right not to proceed with carrying out the promotional action if, by the reflected start date, a participation of more than 1000 has not been registered. Likewise, the Company may extend the termination of the promotional action. for 2 more weeks, with the new end date being March 1, 2024 at 11:59 p.m. in case a number greater than 1000 participation is registered.

3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

The participation requirements will be the following:

Those who reside in Europe and are over 18 years of age may participate.

Only those Participants who have an Instagram account may participate. Group or company profiles are not allowed.

Participants must comment on the brand’s publication on the social network Instagram by tagging 2 friends during the participation period.

Participants may only participate with a single Instagram profile. If it is detected that a Participant participates with several Instagram profiles, they will be disqualified.

Even if Participants write several comments on the same publication, they will only participate with a maximum of one entry in the random drawing.

The application will accumulate mentions of the same Participant even if they are in different comments.

4.- CONDITIONS OF THE PROMOTION AND PRIZES

A single winner will be chosen at random. The winner will be notified on February 17, 2024 through the brands’ social profiles and the website’s blog https://owlstore.eu/es/blog/.

The prize will consist of a sustainable sweatshirt with an upcycling pocket made with reused paragliders from the OWL brand, choosing the size and color of the stroller model that appears on the owlstore.eu website, includes shipping only in mainland Spanish territory, if the winner resides abroad, you must pay the transportation price.

The prize cannot be exchanged for cash or any other prize, nor can it be exchanged or altered. The Company reserves the right to modify the prize if, on the day of declaring the participant as a winner, there are problems with its stock and colors and, therefore, it is impossible to give it away.

The winner may contact the Company during a period of 15 days from the date it is announced on the brand’s social profile. If such contact does not occur within the stipulated period, the draw will be declared void.

The holding of the draw, as well as the awarding of the prize, are subject to current tax regulations.

5.- DISQUALIFICATIONS AND PENALTY

If it is evident that any of the Participants do not meet the requirements set out in the Rules, or the data provided to participate is not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.

The Company reserves the right to declare the draw void.

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, that are offensive, libelous or discriminatory or that could violate the rights of third parties will not be permitted. Comments against an individual that violate the principles of the right to honor, personal and family privacy, and one’s own image will also not be allowed. We will not be responsible for any damage caused by comments made by Participants in the Promotion, and which at any time could offend the sensitivity of other Participants.

Participation in this Promotion, as well as the publication of the comments made by the Participants in the publications, may not violate the Instagram Community Rules or the Instagram Conditions of Use under any circumstances.

If the Company discovers the use of fraudulent means for participation, such as the use of bots in the comments, the prize will not be awarded and will remain the property of the Company.

7.-EXONERATION OF LIABILITY

By way of example, but not limited to, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use that the Participant makes of the prize. you get from this Promotion.

We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the completion of the Promotion or the total or partial enjoyment of the prize.

In the event that this Promotion cannot be carried out, either due to fraud detected in it, technical errors, or any other reason that is not under the control of the Company and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend it, including the participation web page.

8.- PROTECTION OF PERSONAL DATA

In accordance with the provisions of the General Data Protection Regulation, each participant with the acceptance of these Legal Bases consents to their personal data being incorporated into a file, owned by the latter, for the purpose of managing the draw, as well as disseminating and publicize their results, and process the delivery of the prize.

We inform you that you can exercise your rights of Access, Rectification, Deletion, Opposition, Limitation of processing, Portability, oblivion and not to be subject to automated individual decisions by sending an e-mail to admin@owlstore.eu or by sending a letter addressed to the following address: OWL – Ciudad de Granada 65, local. 08005, Barcelona, attaching in both cases a copy of an identification document.

Without prejudice to any other administrative remedy or judicial action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he has his habitual residence, place of work or place of the alleged infringement, in in case you consider that the processing of your personal data is not appropriate to the regulations, as well as in the case of not seeing satisfaction in the exercise of your rights.

That is why the Participant declares to have been informed of the conditions on protection of personal data, accepting and consenting to the treatment.

9.- CHANGES AND ACCEPTANCE

We reserve the right to modify or expand these promotional bases, to the extent that it does not harm or undermine the rights of the Participants in the Promotion.

The mere fact of participating in the draw implies that the Participant fully accepts the conditions of these Legal Bases. Likewise, participation in a draw of this nature implies acceptance of the rules of the Instagram social network through which it is developed.

10.- APPLICABLE LEGISLATION AND JURISDICTION

These legal bases will be governed in accordance with Spanish law. The Courts and Tribunals of the city of residence of the Participant will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or compliance with these bases.
